According to federal prosecutors who discovered new information in a court filing Friday, 100 more people are expected to be charged in the Capitol attack. The documents were filed as part of a conspiracy case, which involved nine alleged associates of the paramilitary group known as the “Oath Keepers.”

The DOJ has requested a 60-day delay in the case by citing its complexity and the massive amount of potential evidence. This came after newly sworn-in Attorney General Merrick Garland took the Oath of Office Thursday and less than an hour later, the nation’s top cop received an FBI briefing on the probe of the January 6 Capitol breach.

FBI Director Christopher Wray pledged to put the agency’s resources toward prosecuting acts of violent extremism and Garland promised the same during his Senate Confirmation Hearing. However, Garland also took heat for shying away from labeling 2020’s Portland riots, unlike the Capitol breach, as domestic terrorism because the courthouse was not “in operation” at the time. He said both were serious crimes, but believed the Capitolprotests carried more weight and were a core attack on our democratic institutions.

However, during his address to the DOJ, Garland said norms require like-cases to be treated alike. He stated:

“That there not be one rule for Democrats, and another for Republicans. One rule for friends, and another for foes. One rule for the powerful and another for the powerless. One rule for the rich, and another for the poor. Or different rules depending on ones race or ethnicity.”

The prosecution in the Capitol attack is expected to be the largest in American history.
